EU-Switzerland Framework Agreement Put to the Test

In the spring of 2018, the Swiss Government agreed in principle to accepting in a future ‘Framework Agreement’ with the EU a dispute settlement mechanism that appears to stem from the EU’s association treaties with the former Soviet Republics of Georgia, Moldova and Ukraine. The British government followed suit in the summer of 2018 in the draft EU Withdrawal Agreement.
Formally, an arbitral tribunal is at the centre of this mechanism. In practically all significant cases, however, the arbitral tribunal is obliged to refer the matter to the ECJ for a binding ruling.
